Article 2 - Purpose and Acceptance of the General Terms and Conditions
These general terms and conditions of sale (GTC) apply to all product orders placed on the Simsima Caftans website. By placing an order, the customer declares to have read and accepted these GTC without reservation, which supersede any other document.
Article 3 - Product Characteristics
The products offered for sale, particularly the caftans, are described and presented as accurately as possible. Photographs and descriptions are not contractual and may show slight variations (color, size, etc.) compared to the final product, due to the handcrafted nature of the items.
Article 4 - Ordering and Payment
Ordering process: The customer selects the product(s), adds them to their cart, and then confirms their order. The order is finalized after entering the delivery and payment information.
Payment: Payment is due at the time of order. Accepted payment methods are credit card and PayPal. The order will only be processed after payment confirmation.
Article 5 - Prices
Prices are shown in Moroccan Dirhams (MAD) or Euros (€), depending on the currency displayed. They do not include delivery charges unless otherwise stated. Prices are subject to change at any time, but products will be billed based on the rates in effect at the time the customer confirms the order.
Article 6 - Delivery
Delivery time: Delivery times are estimates only and are not guaranteed. We cannot be held responsible for delivery delays caused by the carrier or customs formalities.
Delivery charges: Delivery charges are calculated at the time of order and are the responsibility of the customer.
Upon receipt: The customer is responsible for checking the condition of the package and products. In case of damage, they must make clear and precise reservations to the carrier.
Article 7 - Right of Withdrawal and Returns
Return period: The customer has 48 hours from receipt of their order to report a problem and request a return. After this period, no returns or exchanges will be accepted.
Return conditions: Products must be returned in their original condition, unworn, unwashed, and with their original tags attached. Return shipping costs are the responsibility of the customer.
Refund: The refund will be made by the same payment method used for the purchase or via bank transfer, within 48 hours of receiving the returned products and verifying them through our services.
Article 8 - Personal Data
The personal information collected is necessary for processing your order. It is processed in accordance with the regulations in force in Morocco. You have the right to access, rectify, and delete your data.
Article 9 - Applicable Law and Disputes
These Terms and Conditions are governed by Moroccan law. In the event of a dispute, the parties will endeavor to resolve it amicably. Failing an agreement, the competent courts in Morocco shall have exclusive jurisdiction.
